3. Utilize additional features explicitly provided by GetMegaViral.com for user interaction, subject to these Terms of Use and any applicable Additional Terms.
4. Usage Subscription Terms: Purchases of usage subscriptions or virtual items are non-refundable and hold no monetary value. These purchases grant a limited, revocable license for personal use only. Transfers or trades of subscriptions are prohibited. Suspension or termination may result in forfeiture of subscriptions or items, except where noted in Additional Terms. GetMegaViral.com is not liable for modifications, errors, or damages related to subscriptions or virtual items, as permitted by law.
5. Respecting Intellectual Property: Users must respect the intellectual property rights of GetMegaViral.com and other parties when using the Services. Unauthorized use of Content may result in legal consequences. For concerns about copyright infringement, please refer to Section 5.
6. Limited Rights: These Terms of Use and any Additional Terms provide narrow, specific rights to access and use the Services and Content. No additional rights or licenses are implied or granted. ALL RIGHTS NOT EXPLICITLY GRANTED ARE RESERVED BY GetMegaViral, ITS LICENSORS, AND OTHER THIRD PARTIES. Unauthorized use of Content or Services is prohibited.
7. Third-Party Services: GetMegaViral.com is not responsible for third-party content, advertisements, applications, or websites ("Third-Party Services") integrated with or linked to our Services. This includes the ability to use third-party tools for registration or content sharing. Exercise caution when interacting with third parties and review their terms and privacy policies. GetMegaViral.com disclaims liability for damages resulting from use of Third-Party Services. Mobile operating system platforms are considered Third-Party Services. For Apple-specific terms, refer to the Additional Terms below.

2. Content You Submit; Interactive Community Rules.

  1. User-Generated Content (UGC). GetMegaViral.com may offer users the opportunity to submit content through our Services or in response to our presence on third-party platforms. This includes, but is not limited to, messages, text, illustrations, files, images, graphics, photos, comments, responses, sounds, music, videos, information, ratings, reviews, data, questions, suggestions, and personally identifiable information (collectively, "User-Generated Content" or "UGC").

You may submit UGC through various channels, including your profile, forums, blogs, message boards, social networking environments, content creation and posting tools, subscription services, gameplay, social communities (including the Interactive Community, if applicable), contact us tools, email, and other communication functions.

UGC submission methods may include:• Our Services• Our pages or posts on third-party platforms• Our promotions• Our social media pages (e.g., Facebook)• Responses to our tweets• Sweepstakes or contests• Direct submissions

Except for the rights and license you grant in these Terms of Use and any applicable Additional Terms, you retain all legally recognizable rights, title, and interest in your UGC. This excludes GetMegaViral.com Licensed Elements included in your UGC.

3. Using the Services; Services and Content Use Restrictions.


‍1. Account Creation: You must be of legal age to create an account and are responsible for its security. Usernames and passwords should be unique and not offensive.
‍2. Subscriptions, Rentals, Purchases & Taxes: To access certain features, you might need to purchase or subscribe. Transactions are subject to additional terms and taxes may apply.
‍3. Service Use Restrictions: You cannot use the services for political or commercial purposes, harm individuals or entities, reverse engineer the services, or interfere with other users' access.
‍4. Content Use Restrictions: You cannot copy or distribute Content, alter it, or use it in any way not specifically permitted.
‍5. Availability of Services and Content: GetMegaViral.com can suspend or terminate services or content at any time without notice.
‍6. Age of Users: Services are intended for adults or individuals 16 or older with adult consent. Those under 18 need parental supervision.
‍7. Internet Connectivity Charges: You are responsible for any internet connectivity fees associated with using the Services.

1. Account Creation and Management. Only individuals of legal age or their authorized representatives may establish accounts. While we do not authenticate accounts, we reserve the right to address disputes regarding account creation or authenticity at our discretion. As an account holder, you are responsible for maintaining the security of your credentials, controlling access to your device, and all activities associated with your account. Choose unique, non-offensive usernames and passwords that do not infringe on others' rights. We may reject any login credentials at our discretion. You are accountable for keeping your registration information current. Promptly report any unauthorized access or security breaches to us, though you remain liable for any subsequent unauthorized use. Account transfers or assignments are prohibited.

2. Subscriptions & Billing

2.1 Subscriptions; Rentals; Purchases; Taxes. In order to access certain features of the Services, you may be required to make a purchase or enter into a subscription. Moreover, some aspects of the Services may allow you to place orders for or rent products.
Your GetMegaViral.com subscription will continue until terminated. To use the some GetMegaViral.com services you must have Internet access and a social media account already, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).
We may offer a number of subscription plans, including subscription plans that contain commercial breaks and other types of commercial messages (“Advertisements”). Please note that our subscription plans without Advertisements may still contain limited commercial content, such as branded content or sponsorship messaging. In addition, we may give our users the opportunity to use by a limited new features of our service to enjoy as testing or trials for future new additional features. Such content and new features may contain Advertisements independent of your subscription plan.
Some subscriptions are offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. In addition, some subscription plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you.

2.1.1 Any deal terms presented to you at the time of subscription, rental, purchase, or other transaction you conduct on or initiate on the Services (“Transaction”) shall be considered Additional Terms. You agree to pay GetMegaViral.com all charges at the prices presented to you or your agent(s). Prices are subject to change at any given time without notice. You must provide, and you authorize GetMegaViral.com to charge, your chosen payment provider (your “Payment Method”) when you make a purchase or subscribe to paid Services. You agree to make payment using that selected Payment Method and will only provide us information about payment methods that you are authorized to use. We allow you to save and manage your information about your Payment Method, including the full credit card number, account number, and expiration dates, for future purchases or transactions on our site or an certified third-party payment provider. You may make changes to your default Payment Method at any time. If we are unable to charge one payment card, we may charge another valid credit card that you have entered for use on our site. You are responsible for maintaining the accuracy of the information that we have on file, and you consent to GetMegaViral.com updating such stored information from time to time based on information provided by you, your bank or payment services processors. If you initiate a chargeback dispute for any payment or transaction made on our site, GetMegaViral.com reserves the right to terminate the provision of services or delivery or products to you pending resolution of the chargeback dispute with the credit card issuer.

2.1.2 Subscription fees may be automatically renewed and are subject to the refund policy listed below.
2.1.3 Some Transactions may be subject to taxes in certain states. Depending on your state and the nature of the product or Services you receive from us, this may be a rental tax, sales tax and/or use tax. Tax rates are different from state to state. You are responsible for paying all such taxes.
2.1.4 Prices are subject to change at any given time without notice.

‍2.1.5 Promotional Offers. We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by GetMegaViral.com at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Members with an existing or recent GetMegaViral.com membership may not be eligible for certain introductory Offers. We may use information such as device ID, social media user account, method of payment or an account email address used with an existing or recent Netflix membership to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.

‍2.2 Billing Cycle.The subscription fee for the GetMegaviral.com service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the"Account" page. The length of your billing cycle will depend on the type of subscription plan that you choose when you signed up for the service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month. Visit the GetMegaViral.com website and click on the "Billing details" link on the "Account" page to see your next payment date, This Date information is also included on your emailed payment receipt. We may authorize your Payment Method in anticipation of subscription or service-related charges through various methods, including authorizing it for up to approximately one month of service as soon as you register. If you signed up for GetMegaViral.com using your account with a third party as a Payment Method, you can find the billing information about your GetMegaViral subscription by visiting your account with the applicable third party.

2.3 Payment Methods. To use the GetMegaViral service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
2.3.1 Updating your Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

3. Services Use Restrictions. You agree that you will not: (i) use the Services for any political or commercial purpose (including, without limitation, for purposes of advertising, soliciting funds, collecting product prices, and selling products); (ii) use any meta tags or any other “hidden text” utilizing any Intellectual Property; (iii) engage in any activities through or in connection with the Services that seek to attempt to or do harm any individuals or entities or are unlawful, offensive, obscene, lewd, lascivious, filthy, violent, threatening, harassing, or abusive, or that violate any right of any third-party, or are otherwise objectionable to GetMegaViral.com; (iv) decompile, disassemble, reverse engineer, or attempt to reconstruct, identify, or discover any source code, underlying ideas, underlying user interface techniques, or algorithms of the Services by any means whatsoever or modify any Services source or object code or any Software or other products, services, or processes accessible through any portion of the Services; (v) engage in any activity that interferes with a user’s access to the Services or the proper operation of the Services, or otherwise causes harm to the Services, GetMegaViral.com, or other users of the Services; (vi) interfere with or circumvent any security feature (including any digital rights management mechanism, device or other content protection or access control measure) of the Services or any feature that restricts or enforces limitations on use of or access to the Services, the Content, or the UGC; (vii) harvest or otherwise collect or store any information (including personally identifiable information about other users of the Services, including email addresses, without the express consent of such users); (viii) attempt to gain unauthorized access to the Services, other computer systems or networks connected to the Services, through password mining or any other means; or (ix) otherwise violate these Terms of Use or any applicable Additional Terms.

4. Content Use Restrictions. You also agree that, in using the Services, you will: (i) not monitor, gather, copy, or distribute the Content (except as may be a result of standard search engine activity or use of a standard browser) on the Services by using any robot, rover, “bot”, spider, scraper, crawler, spyware, engine, device, software, extraction tool, or any other automatic device, utility, or manual process of any kind; (ii) not frame or utilize framing techniques to enclose any the Content (including any images, text, or page layout); (iii) keep intact all trademark, copyright, and other Intellectual Property and other notices contained in the Content; (iv) not use the Content in a manner that suggests an unauthorized association with any of our or our licensors’ products, services, or brands; (v) not make any modifications to the Content (other than to the extent of your specifically permitted use of the GetMegaViral.com Licensed Elements, if applicable); (vi) not copy, modify, reproduce, archive, sell, lease, rent, exchange, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, retransmit, circulate or transfer to any third-party or on any Third-Party Services, or otherwise use or exploit the Content in any way for any purpose except as specifically permitted by these Terms of Use or any applicable Additional Terms, or with the prior written consent of an officer of GetMegaViral.com or, in the case of the Content from a licensor or owner of the Content; and (vii) not insert any code or product to manipulate the Content in any way that adversely affects any user experience or the Services.

Service Availability and Modifications: GetMegaViral.com reserves the right to modify, suspend, or terminate any aspect of our Services or Content at our discretion, without prior notice or liability. We strive to maintain consistent service but may need to make changes to ensure optimal performance and user experience.

‍6. Age Requirements: Our Services are primarily intended for adults (18 years or older). Users between 16 and 18 may access the Services with parental or guardian consent and supervision. We encourage all users under 18 to review these Terms of Use with a responsible adult to ensure full understanding.

‍6. Internet Connectivity and Associated Costs: Accessing our Services requires internet connectivity. Users are responsible for any fees related to their internet access, including data charges from internet service providers or wireless carriers. GetMegaViral.com is not liable for any costs incurred through the use of our Services.

4. Wireless Features; Messages; Location-Based Features.

Wireless Features: The services may offer features and services via your wireless device, such as accessing services, uploading content, receiving messages, and downloading applications. Standard message, data, and other fees may be charged by your carrier.
‍Text & Email Messages: You may subscribe to text marketing or other text messaging programs. You consent to receive ongoing text alerts (including by auto-dialers) from us. You also consent to receive a text confirming any opt-out as well as non-marketing administrative or transactional messages. You can modify our email marketing communications you receive from us by following the instructions contained within our promotional emails.‍
‍Location-Based Features: If GPS, geo-location, or other location-based features are enabled on your Device, your Device location may be tracked and shared with others. You can terminate Device location tracking by uninstalling the application. Location-based services are for individual use only and should not be used or relied on in any situation in which the failure or inaccuracy of use of the location-based services could lead directly to death, personal injury, or physical or property damage.

5. Notice and Take Down Procedure for Claims of Infringement.

DMCA NotificationGeneralities; If you believe your copyrighted work is being infringed on the Services, you can submit a DMCA notice to our copyright agent.If you are a copyright owner who would like to send us a notice pursuant to the Digital Millennium Copyright Act (“DMCA”) to identify content or material posted on the Services that is infringing and that you would like removed from our Services, or if you are a user whose work has been removed in response to such a notice of infringement and would like to file a DMCA counter-notice, you may submit such notice to us by following the instructions in this Section 5.

DMCA Counter-Notification Process
If your submitted work on our Services is disabled or removed due to a DMCA copyright infringement notice, and you believe this action was taken in error, you may submit a "Counter-Notification" to the email address provided earlier. Your counter-notification should include the following:
1. Subject line: "DMCA Counter-Notification"
2. Detailed description of the removed material and its previous location (including full URL)
3. A statement, under penalty of perjury, asserting your good faith belief that the material was removed due to mistake or misidentification
4. Your complete contact information and account username (if applicable)
5. Consent to jurisdiction of the relevant Federal District Court and acceptance of service of process from the DMCA notification provider
6. Your electronic or physical signature
7. Handling DMCA Counter-Notifications. Upon receiving a valid DMCA Counter-Notification, we may reinstate the removed material within 10 to 14 business days, unless we are notified of pending legal action. We will forward the counter-notification to the original complainant and adhere to DMCA procedures. Counter-Notifications must comply with Section 512(g)(3) of the U.S. Copyright Act. Please note that GetMegaViral.com and its affiliates will not participate in copyright disputes. Be aware that misrepresenting copyright infringement may result in liability for damages.

6. Product Specifications; Pricing; Typographical Errors.

We make every effort to provide accurate descriptions of our products and services on the Services. However, we cannot guarantee that all specifications, pricing, or other content on the Services are entirely complete, accurate, reliable, current, or free from errors. GetMegaViral.com reserves the right to refuse or cancel any orders at its sole discretion, as permitted by applicable law. Please understand that your orders are considered offers to purchase, subject to our acceptance. We may reject or cancel these offers, but will provide a refund if your credit or other account has already been charged.

Additional terms and conditions may apply to specific purchases. In the event that a product you purchased or accepted from GetMegaViral.com is not as described, your sole remedy, as permitted by applicable law, is to return the product or cancel the purchase and receive a credit for the purchase price.

7.Product-Service audience growth: Types of Accounts.

GetMegaViral technology and service take a multifaceted approach to audience promotion and follower growth. To achieve this, we prioritize transparency and integrity in our operations. At GetMegaViral.com we value the opportunity to clarify our approach. We understand that some growth strategies' secondary effects lie beyond our full control, form part of any common accounts and its existence or  continuance depend on each social platform's security controls, filters, and verification methods. Therefore, we provide information about the most common types of Instagram accounts that may become followers after starting our growth services. However, this list is not exhaustive:

‍(1) Real Accounts: These are accounts owned and operated by genuine individuals or businesses. They typically represent authentic users engaging with the platform. (2). Business Accounts: Designed for businesses, brands, or organizations, these accounts offer additional features such as insights and advertising options to help promote products or services. (3). Creator Accounts: Tailored for content creators, influencers, or public figures, these accounts provide access to tools for managing and analyzing content performance. (4). Verified Accounts: Indicated by a checkmark badge, verified accounts are authenticated as being the official presence of notable public figures, celebrities, brands, or entities. (5). Private Accounts: Users can set their accounts to private, meaning only approved followers can view their posts and stories. This enhances privacy and control over who can access their content. (6). Bot Accounts: These are automated accounts programmed to perform specific actions, such as liking, commenting, or following/unfollowing users. They are often used to inflate follower counts or engagement metrics, also known as artificial growth. These are some of the common types of Social network accounts, each serving different purposes and catering to diverse audiences and objectives.

Fake Accounts: There is no universally agreed-upon definition of fake follower accounts. For the purposes of this contract, we consider fake accounts on social media platforms to be those that are either not associated with a real person or are created using an actual person's personal information without their consent. It is not GetMegaViral.com's responsibility to approve or disapprove new followers or subscribers on the customer's associated account for audience growth promotional services.
‍Suspicious Accounts. We consider suspicious accounts when the account or audience has minimum of two of the following: more than 30% of followers/subscribers that violate the terms of each platform’s terms of use and policies; no posts, followers or interactions in the last 6 months. This means that any account and its normal audience growth may include various types of followers or subscribers. We inform our customers that they should expect a percentage of suspicious accounts within their follower base, but this percentage should remain within the range mentioned above.

The secondary effects of audience growth strategies lie beyond our full control, as they involve existing accounts that may follow or subscribe to others. The presence and persistence of these accounts on each social media platform depend on the platform's security measures, filters, and verification processes and terms of use. When you utilize our promotional services for promotions and audience growth, any of these account types might follow your account if it's public. For security purposes, we strongly advise all our customers and users to review and approve new followers or subscriptions, verifying their legitimacy and consciously authorizing access to their digital content. GetMegaViral.com is not responsible for the type of accounts or legitimacy of gained new followers/subscribers. This responsibility rests with the customer, the social media platform security protocols, terms and policies as well as its users' decision to follow/subscribe other accounts.

8. Termination or Suspension.

1. Termination by Us.
We may, upon notice to you, issue a warning, temporarily suspend, indefinitely suspend, or terminate your account or your access to all or any part of the Services for any reason in our sole discretion. In certain cases, in our sole discretion, we may provide you with a written notice (a “Restriction Notice”) to inform you: (a) your right to use or access any part of the Services has been terminated, including the right to use, access or create any account thereon; (b) we refuse to provide any Services to you; and (c) any subsequent orders placed by you will be subject to cancellation. Other conditions may apply and shall be set forth in the Restriction Notice.

‍2. For You to Terminate.
You may terminate these Terms of Use by ceasing all use of the Services and deleting all Licensed Elements from your Device.
‍Unsubscribing from Our Services
Subscription and Billing: Our service offers two billing modes: monthly and yearly.
Unsubscribe Process:

Upon suspension or termination of your access to the Services, or upon notice from GetMEgaViral.com, all rights granted to you under these Terms of Use or any applicable Additional Terms will cease immediately, and you agree that you will immediately discontinue use of the Services. The provisions of these Terms of Use and any applicable Additional Terms, which by their nature should survive your suspension or termination will survive, including the rights and licenses you grant to GetMegaViral.com in these Terms of Use, as well as the indemnities, releases, disclaimers, and limitations on liability and the provisions regarding jurisdiction, choice of law, no class action, and mandatory arbitration.

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL ANY GetMegaViral.com PARTIES BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND, including personal injury or death or for any direct, indirect, economic, exemplary, special, punitive, incidental, or consequential losses or damages of any kind, including without limitation loss of profits, in connection with, or otherwise directly or indirectly related to the Services (including the Content and the User Generated Content), including without limitation:your use of or inability to use the Services, or the performance of the Services;any action taken in connection with an investigation by GetMegaViral.com Parties or law enforcement authorities regarding your access to or use of the Services;any action taken in connection with copyright or other Intellectual Property owners or other rights owners;any errors or omissions in the Services’ technical operation or security or any compromise or loss of your UGC (UserGenerated content) or other data or information; orany damage to any user’s computer, hardware, software, modem, or other equipment or technology, including damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line, or network failure or any other technical or other malfunction, including losses or damages in the form of lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or equipment failure or malfunction. The foregoing limitations of liability will apply even if any of the foregoing events or circumstances were foreseeable and even if the GetMegaViral.com Parties were advised of or should have known of the possibility of such losses or damages, regardless of whether you bring an action based in contract, negligence, strict liability, or tort (including whether caused, in whole or in part, by negligence, acts of God, telecommunications failure, or destruction of the Services).

EXCEPT AS MAY BE PROVIDED IN ANY APPLICABLE ADDITIONAL TERMS, TO THE FULLEST EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT WILL THE GetMegaViral.com PARTIES’ TOTAL LIABILITY TO YOU, FOR ALL POSSIBLE DAMAGES, LOSSES, AND CAUSES OF ACTION IN CONNECTION WITH YOUR ACCESS TO AND USE OF THE SERVICES AND YOUR RIGHTS UNDER THESE TERMS OF USE, EXCEED AN AMOUNT EQUAL TO THE AMOUNT YOU HAVE PAID GetMEgaViral.com IN CONNECTION WITH THE TRANSACTION(S) THAT UNDERLIE THE CLAIM(S); PROVIDED, HOWEVER, THIS PROVISION WILL NOT APPLY IF A COURT OR TRIBUNAL WITH APPLICABLE JURISDICTION FINDS SUCH TO BE UNCONSCIONABLE. FOR PURPOSES OF CLARITY, THE PRIOR SENTENCE DOES NOT EXPAND OR LIMIT ANY EXPRESS, WRITTEN PRODUCT WARRANTY THAT IS PROVIDED BY GetMegaViral.com OR A MANUFACTURER OF A PHYSICAL PRODUCT. The liability limitations in this Section 8 are not intended to limit any express warranties from applicable product manufacturers of physical products sold via the Services, or any express warranties by GetMegaViral.com that are included in applicable Additional Terms.

5. APPLICABLE JURISDICTIONAL LIMITS. CERTAIN JURISDICTIONS, SUCH AS NEW JERSEY, DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF OR LIMITATION OF CERTAIN DAMAGES. AS SUCH, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

ESSENTIAL PURPOSE UNLESS LIMITED OR MODIFIED BY APPLICABLE LAW, THE FOREGOING DISCLAIMERS, EXCLUSIONS AND LIMITATIONS APPLY, EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

10. Arbitration and Dispute Terms.

Forum Selection/Jurisdiction: Any disputes arising from or related to the Services, Content, User-Generated Content (UGC), these Terms of Use, or any applicable Additional Terms (collectively, "Dispute") shall be subject to the jurisdiction and venue of Wyoming. Both parties hereby consent to personal jurisdiction and venue in Wyoming for all relevant purposes.
2. Pre-Arbitration Dispute Resolution: GetMegaViral.com and you acknowledge the benefit of attempting to resolve Disputes through discussion prior to initiating formal proceedings. However, GetMegaViral.com reserves the right to bypass this step for matters concerning Intellectual Property rights ("IP Disputes"). For all other disputes ("General Disputes"), the initiating party shall provide written notice to the other party, outlining the claim and desired resolution.GetMegaViral.com will send such notices to the email address associated with your account. If this information is unavailable or outdated, GetMegaViral.com's notification obligations under this section are waived.To notify GetMegaViral.com of a claim, please direct your communication to: contact@GetMegaViral.com, Attention: Legal Department.If the Dispute remains unresolved 60 days after notification, the claimant may proceed with formal proceedings as outlined in Section 9. Notwithstanding this process, either party may seek provisional remedies, such as preliminary injunctive relief, as permitted under Section 9(d), prior to the expiration of the 60-day resolution period.
3. Arbitration Process. If you do not opt out within five (5) business days of first using our Services by emailing contact@GetMegaViral.com (Attn: Legal Department), all disputes will be resolved through binding arbitration. This process will be conducted by JAMS (www.jamsadr.com) in Wyoming, using their Comprehensive Arbitration Rules for disputes over $250,000, or Streamlined Arbitration Rules for disputes of $250,000 or less. For consumer disputes, JAMS will follow its Policy on Consumer Arbitration. The arbitrator will be mutually agreed upon or selected from a JAMS-provided list. GetMegaViral.com may cover JAMS fees if necessary for enforceability. Arbitration proceedings are confidential, though parties may share information with their professional advisors. The arbitrator will provide a written decision with findings and conclusions. Legal action in court is prohibited until arbitration is complete, except for seeking preliminary relief or enforcing the arbitrator's decision. The losing party has 15 business days to comply before the prevailing party may seek enforcement through the appropriate court. Any challenges to arbitrability will be determined by the arbitrator.
4. Limitation on Injunctive Relief. In accordance with applicable law, if you assert that you have experienced any losses, damages, or injuries related to your use of the Services, such losses, damages, or injuries will not be considered irreparable or sufficient to warrant an injunction or other equitable relief. This provision implies that, in connection with your claim, you acknowledge and agree that you will not pursue, nor will you be granted, any legal action that could potentially impede or obstruct the development or utilization of the Services, Content, User-Generated Content (UGC), products, or intellectual property owned, licensed, used, or controlled by any GetMegaViral.com entity (including your licensed UGC).
5. Governing Law. These Terms of Use and any applicable Additional Terms, General Disputes and IP Disputes, and any other claim brought by you against the GetMegaViral.com Parties or by GetMegaViral.com against you pursuant to this Section 9, or otherwise related to the Services, Content, Licensed Elements, UGC, products or GetMegaViral.com Intellectual Property, will be governed by, construed, and resolved in accordance with, the laws of the State of Wyoming, U.S.A., without regard to its conflicts of law provisions that might apply the laws of another jurisdiction. This Section 9 shall be governed solely by the Federal Arbitration Act, 9 U.S.C. §1, et seq., and not by the law of any state, and is enforceable pursuant to its terms on a self-executing basis. You and GetMegaViral.com agree that we intend that this Section 9 satisfies the “writing” requirement of the Federal Arbitration Act. This Section 9 can only be amended by mutual agreement. Either party may seek enforcement of this Section 9 in any court of competent jurisdiction.
6. Class Action Waiver. In accordance with applicable law, both you and GetMegaViral.com agree to waive the right to initiate or participate in any class, consolidated, representative, collective, or private attorney general action regarding any Dispute. This waiver extends to actions brought by you or anyone else. The arbitrator lacks the authority to conduct the arbitration as a class, consolidated, representative, or private attorney general action, or to combine Disputes from multiple parties into a single proceeding. Should this waiver be deemed unenforceable, any class, collective, representative, or private attorney general claims must be addressed through appropriate court proceedings, not arbitration. This provision ensures that all Disputes are handled on an individual basis, promoting efficient and personalized resolution of issues between you and GetMegaViral.com.
7. Waiver of Jury Trial. To the extent permitted by applicable law, both parties voluntarily relinquish their right to a jury trial for any disputes arising from or related to these Terms, including their interpretation, enforcement, or alleged breach. This waiver encompasses all claims, whether based in contract, tort, or other legal theories, and extends to any assertions of fraudulent inducement regarding these Terms.
8. Small Claims Matters. Notwithstanding the foregoing, either of us may bring qualifying claim of General Dispute (but not IP Disputes) in small claims court, subject to Section 9(f).
9. Survival. The provisions of this Section 9 shall supersede any inconsistent provisions of any prior agreement between the parties. This Section 9 shall remain in full force and effect notwithstanding any termination of your use of the Services or these Terms of Use.

11. General Provisions.

1. GetMegaViral.com's Discretionary Authority: In instances where these Terms of Use or Additional Terms grant GetMegaViral.com discretionary rights or approval authority, such rights will be exercised at GetMegaViral.com's sole discretion. Official consent or approval from GetMegaViral.com must be in writing and signed by an authorized officer.
2. Indemnification Obligation: To the extent permitted by law, you agree to defend, indemnify, and hold harmless GetMegaViral.com and its affiliated parties from any claims, damages, losses, costs, or liabilities arising from: (i) your user-generated content; (ii) your use of the Services; (iii) your breach of these Terms or Additional Terms; (iv) your violation of applicable laws or regulations; (v) any infringing material transmitted through your device; (vi) any misrepresentations made by you; and (vii) GetMegaViral.com's use of information you provide, subject to our Privacy Policy. You will cooperate in the defense of any such claims. GetMegaViral.com reserves the right to assume control of the defense and settlement of any claims. This provision does not limit any non-waivable legal rights you may have.
3. Service Jurisdiction: GetMegaViral.com operates the Services from the United States and makes no representations regarding their appropriateness or availability for use in other locations. Users accessing the Services from outside the U.S. do so at their own initiative and are responsible for compliance with local laws.
4. Export Compliance: Users are responsible for adhering to all applicable domestic and foreign trade regulations and laws. Unless authorized by U.S. law, users agree not to export or re-export the software to any country, person, entity, or end-user subject to U.S. export controls or sanctions.
5. Interpretation Guidelines: Section headings are for reference only and do not affect the interpretation of terms. "Including" means "including, but not limited to." Singular includes plural and vice versa. These Terms of Use and applicable Additional Terms are binding on all parties and their successors and permitted assigns.
6. Comprehensive Agreement: This agreement, along with any applicable Additional Terms, constitutes the entire understanding between you and GetMegaViral.com regarding the use of the Services, superseding all prior agreements on this subject matter.Severability Clause: If any provision of these Terms is deemed invalid or unenforceable in any jurisdiction, it shall be ineffective only to that extent in that jurisdiction, without affecting the validity or enforceability of the remaining provisions.
7. Third-Party Beneficiaries: GetMegaViral.com's affiliates, suppliers, licensors, and other associated parties are intended third-party beneficiaries of these Terms of Use.
8. Non-Waiver Provision: GetMegaViral.com's failure or delay in exercising any right, remedy, or provision under these Terms does not constitute a waiver of that or any other right, remedy, or provision.

10. Force Majeure: GetMegaViral.com shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, civil unrest, technological failures, or regulatory changes.

We may also amend these Terms of Use periodically. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
12. Assignment Clause: You may not assign or transfer your rights and obligations under these Terms without GetMegaViral.com's prior written consent. 12. Refund Policy.

All new yearly billed purchases come with a 30-day guarantee, while new monthly billed purchases have a 7-day guarantee. For both billing types, customers may: 1. Cancel their subscription 2. Receive a refund of the original amount charged. These actions must be requested within the specified guarantee period.
For monthly billings after seven days, and for yearly billings after thirty days from the original purchase date, services are already being rendered. GetMegaViral.com will only cancel the subscription but not provide a refund, as mentioned in our terms.
